On May 5, 2020, TCH partner Alan Holcomb was published in the online legal journal, legalreader.com. His article, entitled "COVID-19 Impacting Personal Injury Law," discusses how the current pandemic is affecting the practice of personal injury law and how personal injury attorneys can continue to push their cases despite challenges posed by lockdown orders and court closures.
In the article, Alan discusses how personal injury lawyers are using technology to conduct online depositions, hearings, and mediations. He also discusses the importance for trial lawyers to remain aggressive in their cases, despite the current challenges.
As Alan wrote: "Ultimately, the main objective is to apply as much force to the defendant's 'pressure point' as possible despite the current obstacles. Even if it is currently impossible to conduct a jury trial, the threat of a jury trial remains the most powerful 'pressure point' for both defense lawyers and insurance companies. Insurance companies fear the unpredictable, and juries are, by their very nature, unpredictable. Trial lawyers must thoroughly prepare their cases for trial despite the current challenges and constantly remind insurance companies that a hard-fought jury trial will be coming . . ."
